Man found in car after shooting on Schaum sentenced to 11 months in prison

A man arrested out of a vehicle in connection with the shooting on Schaum Avenue in April was sentenced to nearly one year in prison Wednesday morning.

Dustan McDew, 23, pleaded guilty in June to one fourth-degree felony count of improper handling of a firearm in a motor vehicle while loaded and one second-degree misdemeanor count of resisting arrest.

At the beginning of April, officers with the Zanesville Police Department found McDew, who had an active warrant, unresponsive in a vehicle near 523 Schaum Ave., Assistant Prosecuting Attorney Ron Welch said in court during McDew’s plea hearing.

Officers observed a shotgun inside the vehicle and attempted to get McDew out of the vehicle. McDew resisted until officers were eventually able to take him into custody.

The gun was recovered, Welch said.

During his sentencing hearing, McDew’s attorney said her client accepted responsibility for his actions during the incident and requested the judge follow the joint recommendation between the State and the defense of 11 months.

“I just apologize to the courts for my actions,” McDew said during his time to speak.

In addition to his 11 month sentence, Judge Kelly Cottrill also ordered McDew to forfeit the shotgun that he was in possession of at the time of his arrest.

McDew was one of eight people arrested in connection to the shooting on April 1, and one of six people charged in the incident.

The other individuals involved included:

  • Kashawn “Duda” Cox — he is awaiting sentencing which is scheduled for Aug. 28.
  • Emily Goodrich — she is awaiting sentencing.
  • Miles Green pleaded guilty to one third-degree felony count of tampering with evidence and one fourth-degree felony count of obstructing justice. He was sentenced to three years of community control Monday afternoon.
  • Mason Brassfield pleaded guilty to one third-degree felony count of tampering with evidence, one fourth-degree felony count of obstructing justice and two fifth-degree felony counts of possession of drugs. He was also sentenced to three years of community control Monday afternoon.
  • Hayley Large was charged with a misdemeanor resisting arrest charge which proceeded through Zanesville Municipal Court.
