Man accused of raping 71 year-old ex-wife pleads guilty to lesser charges

A 52 year-old man pleaded guilty to two counts of sexual battery after his 71 year-old ex-wife accused him of raping her.

According to Assistant Prosecuting Attorney John Litle, the defendant, Larry Mitchell, was staying in the basement of his ex-wife’s house when he picked the lock on the woman’s door to enter her room and sexually assault her the night of April 4.

Again on April 5, just before midnight, the woman heard Mitchell attempting to open her door. With enough warning that time, Litle said she was able to put up a fight and escape to a neighbor’s house where she reported the assault.

When deputies from the Muskingum County Sheriff’s Office arrived, Litle said Mitchell remarked ‘oh, she called?’”

Mitchell claimed he was engaged in a romantic relationship with the victim and they had sex all the time. Litle said that was not the case, saying they had not been involved romantically since their marriage in the 90s. According to Litle, the victim allowed Mitchell to stay with her when he needed a place to live.

Mitchell was originally indicted on four first-degree felony counts of rape and a fourth-degree felony count of gross sexual imposition.

On Monday, he pleaded guilty to two lesser charges of sexual battery — third-degree felonies.

Mitchell was returned to the Muskingum County Jail where he is being held on $250,000 bond.
