Griffith sentenced for sex with minor

An Adamsville man was sentenced Wednesday morning after he provided alcohol and had sex with a minor.

David Griffith, 46, had asked a family friend to help babysit his girlfriend’s children for him.

When he picked the girl up from a club activity, Griffith informed her that he had broken up with his girlfriend, so there would be no need to babysit, but she could still go to his house to hang out.

Griffith’s attorney, Chase Mallory, said that he is a father of a little girl and there is no question that the incident should have never occurred, but to imply that the teenage girl was too drunk to consent was just not believable.

“At most, she had four Mikes Hard Lemonades over the course of multiple hours,” said Mallory.

The girl allegedly consented but regretted the act later, a fact not contested by prosecutors.

Griffith called the incident the biggest mistake of his life.

“It was a bad decision, I was real dumb,” said Griffith as he spoke to Judge Mark Fleegle.

Fleegle said that due to his charge of attempted child endangerment, a fourth-degree felony, he couldn’t send Griffith to prison, something the judge said he doesn’t agree with.

“You said she probably only had three or four, but Detective (Steve) Welker said he found five Mikes Hard Lemonade bottles in your trash, and you admitted you don’t drink Mikes Hard,” said Fleegle.

Fleegle also made light of the 30 year age difference between the two noting how the girl was only 16 years old.

“You knew there were no children to babysit and you still had her come over,” Fleegle said. “If it was up to me, I’d send you to prison.”

Ultimately, Fleegle sentenced Griffith to six months of local incarceration in the Muskingum County Jail and placed him on community control for an additional six months following his release.

Griffith was then handcuffed and taken to begin his sentence.
